Developing in Bland Shire

When preparing to develop in the Shire, it is important to understand the Bland Local Environmental Plan (LEP) 2011 and Bland Development Control Plan (DCP) 2012 which apply to your area, your property or your type of development and check Council's requirements carefully to ensure that your proposal complies with these controls.

Once you are familiar with what applies to your land, including relevant zones, bushfire prone areas etc, you can refer to the LEP to firstly determine whether the proposal is permissible within the Zone and whether it meets any specific site provisions.

The DCP examines issues associated with site analysis and design, and provides principles and performance criteria for site responsive design, context and design solutions for development.

It is recommended that the LEP and DCP be fully considered prior to preparation.

Bland Local Environmental Plan (LEP) 2011

Bland Local Environmental Plan (LEP) 2011 is the principal legal document for controlling development at the Council level. The zoning provisions establish permissibility of uses and standards regulate the extent of development.

Bland Development Control Plan (DCP) 2012

This DCP is made under the environmental planning instrument, "Bland Local Environmental Plan 2011" (the LEP), which contains the statutory planning controls for development within the Bland Shire.  The DCP cannot prohibit or permit a use that is allowed or prohibited under the LEP.  The purpose of the DCP is to provide additional detailed controls for various types of development which supplement or expand on the controls within the LEP.  Click HERE to view the DCP.

Note: Users should review the controls in the LEP before consulting this DCP in determining the controls that apply to particular forms of development.  In the event of an inconsistency between this DCP and the Bland LEP, the LEP takes precedence.

These Section 94 Plans enable Council to levy contributions from new development for the provision and/or upgrading of community facilities and services.
